In the following conditions of contract “The Photographer(s)” shall mean Myklikers Photography or, subject to condition 7 below, any photographers appointed by Myklikers Photography. “The Client(s)” shall be those whose name appears on the contract. The due performance of the contract is subject to the conditions below and they cannot be varied in any way by The Client(s) unless such conditions are expressly agreed by The Photographer(s) in writing.
1. Professional Fees
The professional fees for the above-mentioned scope of services shall be a lump sum of amount depending on packages offered.
2. Mode of Payment
The mode of payment for the Professional Fees shall be as follows:
PHASE Fees for Phase
a) Confirmation Photographer 30%
b) Confirmation Design Custom Album 40%
c) Album Deliver 30%
Note : The Client must clear 1st phase payment 2 week before shooting. Deposit is not refundable for any cancellation.
3. Reimbursement Claims
In addition to the professional fees payable, the following standard reimbursable will also apply:
a) Changing Package After Confirmation
b) Travelling expenses (For outstation work only)
4. Termination of Services
The Client contract may be terminated at any time by either party on the expiry of two (2) months notice in writing. Unreturned deposit for any cancellation made by client within two (2) months from the date of event. In termination of this appointment after shooting, the client shall pay to The Photographer the balance of all outstanding fees up to the stage work has been undertaken.
5. Lost & Damages
Cash money will be return for the damage, lost or any undelivered pictures.
6. Changing Photographer
The Client shall be informed in the event of photographer exchange or inevitable matters such as accident, apparatus damage, emergency etc.
7. Third Party Photography
Priority is given to The Photographer team. The Photographer have right to attract self if there are third party try to block or prevent photographer work and client still need to pay full payment as prescribed.
8. Album Delivery
First album will be deliver within 30 days upon received last payment excluded Saturday & Sunday. Second album will be delivered 30 days after the first album delivered.
In the event of delayed delivery made by The Photographer, The Client will be rewarded a picture frame priced RM200.00.
9. Changes of Date/Time of event
Time and date could not be changed after bookings have been made. Both parties must agreed for the changes (if any) to avoid overlapping with other bookings. In the event of overlapping, exchange photographer would be made and payment might be imposed.
10. Copyright
The copyright in all print picture, album and soft copy prepared by the The Photographer in connection with the Project shall be the property of the The Photographer but the client shall have a license to use such picture for purposes related to the wedding.
